Το Δικαστήριο διευκρινίζει ότι το συμπέρασμα αυτό επεκτείνεται υποχρεωτικά και στα θέματα στα οποία αναφέρονται τα προδικαστικά ερωτήματα στην υπόθεση neath και στην υπόθεση coloroll, δηλαδή στη μετατροπή σε κεφάλαιο μέρους της περιοδικής σύνταξης καθώς και στη μεταφορά συνταξιοδοτικών δικαιωμάτων, των οποίων η αξία καθορίζεται σε συνάρτηση μόνο με τους τρόπους χρηματοδότησης που έχουν επιλεγεί.

Το Δικαστήριο υπογράμμισε ότι το συμπέρασμα αυτό εκτείνεται αναπόφευκτα σε ιδιαίτερες πτυχές στις οποίες αναφέρονταν τα προδικαστικά ερωτήματα στις υποθέσεις neath και coloroll, δηλαδή την εφάπαξ καταβολή μέρους της περιοδικής συντάξεως, καθώς και τη μεταφορά συνταξιοδοτικών δικαιωμάτων, η αξία των οποίων δεν μπορεί να προσδιοριστεί παρά μόνον αναλόγως του επιλεγέντος τρόπου χρηματοδοτήσεως.
