8.– est exclue de l’enregistrement, une marque qui 1. est contraire au droit en vigueur ou aux principes de la vie sociale; 2. lèse les droits personnels ou patrimoniaux de tiers; 3. contient des indications fausses; 4. contient le nom ou une abréviation du nom de la république populaire de pologne ou ses symboles, son emblème, ses couleurs ou l’hymne national, l’insigne des forces armées polonaises, la marque nationale de qualité ou de garantie; 5. contient le nom ou les armoiries d’une voïévodie, ville ou localité polonaise, la reproduction d’une décoration polonaise, d’une distinction, d’une médaille honorifique ou militaire ou d’un insigne militaire; dans des cas justifiés, une telle marque peut être enregistrée à condition que l’unité d’organisation compétente ou l’organe étatique compétent ait donné son approbation préalable; 6. contient le nom, l’abréviation du nom ou les symboles (armoiries, drapeaux, emblèmes) d’un etat membre de l’union de paris pour la protection de la propriété industrielle ou les nom, abréviation du nom ou symboles d’une organisation intergouvernementale dont font partie un ou plusieurs des etats membres susmentionnés, ou le symbole olympique, à moins que le déposant n’établisse qu’il est autorisé à utiliser une telle marque dans l’activité économique.
8.– a trademark shall not be registrable if: i) it is contrary to law or to the principles of society; ii) it infringes the personal or economic rights of third parties; iii) it contains incorrect statements; iv) it contains the name or abbreviated name of the republic of poland or its symbols, emblem, national colors or national anthem, the insignia of the armed forces, the national hallmark of quality or the safety mark; v) it contains the name or armorial bearings of a polish voivodship, town or community, the reproduction of a polish decoration, a distinction, an honorary or military medal or military insignia; in cases where this is justified, such a mark may be registered if the competent state organs or authorities have given their approval; vi) it contains the name, abbreviated name or symbols (armorial bearings, flags, emblems) of a member state of the paris union for the protection of industrial property or the name, abbreviated name or symbols of an intergovernmental organization to which one or more of the member states of the above-mentioned union belong, or the olympic symbol, where the applicant is unable to establish that he is authorized to use such mark in his economic activities.
