a person who has been compulsorily insured under the algemene nabestaandenwet (anw) (netherlands general law on insurance for surviving dependants) shall be deemed, for the purposes of chapter 5 of title iii, to be insured under that legislation at the time when the risk materialises, if that person is insured under the legislation of another member state for the same risk or, failing that, in the case where a survivor's pension is due under the legislation of another member state.
