4. non sono possibili rivendicazioni di garanzia qualora il difetto sia da riportare a mancato rispetto delle istruzioni per l'uso, la manutenzione ed il montaggio, ad utilizzo inadeguato o non appropriato, a trattamento errato o caratterizzato da trascuratezza, a naturale usura ed a interventi effettuati dal cliente o da terzi sull'oggetto della fornitura.

la garanzia legale di cui sopra è valida per il termine massimo di 12 (dodici) mesi dalla consegna del prodotto. oltre tale termine, rameria mazzetti, pertanto, non sarà responsabile dei difetti di conformità riscontrati dal cliente non consumatore.
the aforementioned legal guarantee shall be valid for a maximum of 12 (twelve) months after delivery of the goods. rameria mazzetti shall not be held liable where the lack of conformity becomes apparent to the non-consumer customer beyond the aforementioned term.

al contrario, laddove il tecnico constati che il difetto non sia coperto da garanzia, tutte le spese relative al sopralluogo e alle eventuali opere di riparazione e/o sostituzione – incluse le spese di manodopera, trasporto, vitto e alloggio, materiali sostitutivi – saranno addebitate al cliente. le garanzie sui prodotti sostituiti o riparati ai sensi del precedente paragrafo rimangono in vigore per il solo periodo residuo intercorrente tra la riparazione e/o sostituzione e lo scadere del periodo originario di garanzia relativo al prodotto inizialmente acquistato dal cliente. nessun’altra forma di intervento in garanzia e/o risarcimento potrà essere preteso dal cliente, rimanendo espressamente esclusa ogni responsabilità per danni diretti, indiretti, incidentali o consequenziali che dovessero derivare dalla difettosità e/o non conformità dei prodotti, che devono pertanto, nei limiti consentiti dalla legge, intendersi espressamente rinunciati dal cliente.
