(25) the complaint was lodged on behalf of four out of the five eu ethanolamine manufacturers. one company, union carbide ltd. (25) stížnost byla podána jménem čtyř z pěti výrobců ethanolaminů v eu. jedna společnost, union carbide ltd. (spojené království) se na šetření nepodílela a ke stížnosti se nepřipojila. je třeba poznamenat, že tato společnost je spřízněna s americkým výrobcem union carbide corp. usa. bylo tedy zkoumáno, nemá-li být tato společnost podle čl. 4 odst. 1 základního nařízení vyloučena z definice výroby společenství. bylo zjištěno, že tento výrobce dovážel výrobek za dumpingové ceny ve významném množství. jelikož nebylo možné zaručit, že hospodářská situace tohoto výrobce nebyla ovlivněna jeho spřízněností s americkým výrobcem, byl učiněn závěr, že bude ze stanovení výroby společenství vyloučen. celkovou výrobu společenství tedy představují následující výrobci: basf ag, ludwigshafen, německo, bp chemicals ltd, londýn, spojené království, condea chemie gmbh, marl, německo, a akzo nobel surface chemistry, stenungsund, Švédsko.
