pour les raisons exposées dans le présent rapport, l'organe d'appel: 1. confirme la décision du groupe spécial selon laquelle certains instruments réglementaires qui étaient spécifiés dans la demande d'établissement d'un groupe spécial, mais dont il n'avait pas été question lors des consultations, étaient des mesures soumises à bon droit au groupe spécial; 2. confirme la constatation du groupe spécial selon laquelle, s'agissant d'un différend dans lequel il y a une allégation de violation de l'article 3.1 a) de l'accord smc par un pays en développement membre, il incombe à la partie plaignante de prouver que le pays en développement membre en question n'a pas agi en conformité avec les dispositions de l'article 27.4 dudit accord; 3. confirme les constatations du groupe spécial dont il a été fait appel concernant la détermination du groupe spécial selon laquelle le brésil n'a pas respecté les obligations qu'il a au titre de l'article 27.4 de l'accord smc de "ne pas relever le niveau de ses subventions à l'exportation", et, en particulier, confirme les constatations suivantes du groupe spécial: 1. le "point de référence approprié" pour déterminer si un membre a relevé le niveau de ses subventions à l'exportation est constitué par les dépenses effectives et non par les montants budgétisés; 2. aux fins de l'article 27.4, les subventions à l'exportation pour les aéronefs régionaux au titre du proex devraient être considérées comme étant "accordées" quand les obligations ntn-i sont émises, et non quand la lettre d'engagement est émise; et 3. il est approprié dans la présente affaire d'utiliser des dollars constants, et non des dollars nominaux, pour évaluer si le brésil a relevé le niveau de ses subventions à l'exportation; et en conséquence, confirme les conclusions générales du groupe spécial selon lesquelles le brésil n'a pas respecté les dispositions de l'article 27.4 de l'accord smc, ce qui fait que la prohibition des subventions à l'exportation énoncée à l'article 3.1 a) s'applique au brésil; 4. infirme et modifie l'interprétation donnée par le groupe spécial du membre de phrase "servent à assurer un avantage important sur le plan des conditions du crédit à l'exportation" figurant au point k) de la liste exemplative; mais confirme la conclusion du groupe spécial selon laquelle le brésil n'a pas démontré que les subventions à l'exportation pour les aéronefs régionaux au titre du proex ne "[servaient] [pas] à assurer un avantage important sur le plan des conditions du crédit à l'exportation" au sens du point k); et, en conséquence, confirme le rejet par le groupe spécial du "moyen de défense affirmatif" allégué par le brésil sur la base du point k) de la liste illustrative; 5. confirme la recommandation du groupe spécial visant à ce que le brésil retire les subventions à l'exportation pour les aéronefs régionaux au titre du proex dans un délai de 90 jours; et 6. compte tenu de la constatation formulée plus haut à l'alinéa c) ii), ne fait aucune constatation concernant l'appel conditionnel du canada sur le point de savoir si l'émission des obligations ntn-i est compatible avec l'obligation que le brésil a au titre de l'article 3.2 de l'accord smc de ne pas "maintenir" de subventions à l'exportation prohibées.
for the reasons set out in this report, the appellate body: 1. upholds the ruling of the panel that certain regulatory instruments specified in the request for the establishment of a panel, but not discussed in the consultations, were measures properly before the panel; 2. upholds the finding of the panel that, in a dispute involving a claim of violation of article 3.1(a) of the scm agreement by a developing country member, the complaining party has the burden of proving that the developing country member in question has not acted in compliance with the provisions of article 27.4 of that agreement; 3. upholds the appealed findings of the panel relating to the panel's determination that brazil had failed to comply with its obligations under article 27.4 of the scm agreement to "not increase the level of its export subsidies", and, in particular, upholds the following findings of the panel: 1. that the "proper point of reference" for the purpose of determining whether a member has increased the level of its export subsidies is actual expenditures, rather than budgeted amounts; 2. that for the purposes of article 27.4, the export subsidies for regional aircraft under proex should be considered to be "granted" when the ntn-i bonds are issued, rather than when the letter of commitment is issued; and 3. that it is appropriate in this case to use constant dollars, rather than nominal dollars, in assessing whether brazil has increased the level of its export subsidies; and, therefore, upholds the overall conclusions of the panel that brazil has not complied with the provisions of article 27.4 of the scm agreement, with the result that the export subsidy prohibition in article 3.1(a) applies to brazil; 4. reverses and modifies the interpretation by the panel of the phrase "used to secure a material advantage in the field of export credit terms" in item (k) of the illustrative list; but upholds the conclusion of the panel that brazil failed to demonstrate that the export subsidies for regional aircraft under proex are not "used to secure a material advantage in the field of export credit terms" within the meaning of item (k); and, therefore, upholds the panel's rejection of the "affirmative defence" claimed by brazil on the basis of item (k) of the illustrative list; 5. upholds the recommendation of the panel that brazil shall withdraw the export subsidies for regional aircraft under proex within 90 days; and 6. in light of the finding in (c)(ii) above, makes no finding on the conditional appeal by canada on whether the issuance of the ntn-i bonds is consistent with brazil's obligation not to "maintain" prohibited export subsidies under article 3.2 of the scm agreement.
