جاء بالمادة 5 من قانون البرق الهندي الصادر عام 1885 أنه عند نشوء أي من حالات الطوارئ العامة أو العمل على صون السلامة العامة يجوز للحكومة المركزية أو حكومة الولاية أو أي موظف تفوضه الحكومة المركزية أو حكومة الولاية القيام - عند ثبوت الضرورة أو مسيس الحاجة، وحرصا على سيادة الهند وسلامتها الإقليمية أو على أمن الدولة أو على صون العلاقات الودية مع دولة أجنبية أو حرصا على النظام العام وللحيلولة دون التحريض على ارتكاب جريمة، ولأسباب تسجل خطيا بالأمر المباشر على أي رسالة أو مجموعة رسائل إلى أو من أي شخص أو مجموعة أشخاص تتصل بأي موضوع معين ويؤتى بها إلى مكتب برق لإرسالها أو أرسلها مثل هذا المكتب أو تلقاها - بعدم إرسال هذه الرسالة أو الرسائل أو اعتراض مسارها أو احتجازها أو الكشف عن محتواها للحكومة المصدرة للأمر أو للموظف التابع لها المذكور اسمه في الأمر.
