Η αρχή της ελεύθερης κυκλοφορίας επιτρέπει στα άτομα και στις επιχειρήσεις να προασπίζουν τα αστικά και εμπορικά τους συμφέροντα σε άλλα κράτη μέλη, αλλά ταυτόχρονα καθιστά αναγκαία τη λήψη μέτρων στον τομέα του ποινικού δικαίου τα οποία θα εξασφαλίζουν ότι δεν υπάρχουν ασφαλή καταφύγια για το έγκλημα και τους εγκληματίες. Πράγματι, τα άτομα και οι επιχειρήσεις δεν πρέπει να εμποδίζονται ή να αποθαρρύνονται να ασκήσουν τα δικαιώματά τους λόγω της ασυμβατότητας ή της πολυπλοκότητας των νομικών και διοικητικών συστημάτων των κρατών μελών.
