mit seinen urteilen vom 28. september 1994 (6) (rechtssache c-57/93, vroege gegen nciv instituut voor volkshuisvesting bv, und rechtssache c-128/93, fisscher gegen voorhuis hengelo bv) hat der gerichtshof für recht erkannt, daß das vorgenannte protokoll keine auswirkung auf den anspruch auf anschluß an ein betriebsrentensystem hat, für den weiterhin das urteil vom 13. mai 1986 in der rechtssache 170/84 (bilka-kaufhaus gmbh gegen hartz) (7) gilt, und daß die zeitliche beschränkung der wirkungen des urteils vom 17. mai 1990 in der rechtssache c-262/88 (barber gegen guardian royal exchange assurance group) nicht für den anspruch auf anschluß an ein betriebsrentensystem gilt. der gerichtshof hat auch für recht erkannt, daß arbeitnehmern, die ihren anspruch auf anschluß an ein betriebsrentensystem geltend machen, die innerstaatlichen vorschriften über die fristen für die rechtsverfolgung entgegengehalten werden können, sofern sie für derartige klagen nicht ungünstiger sind als für gleichartige klagen, die das innerstaatliche recht betreffen, und sofern sie die ausübung des gemeinschaftsrechts nicht praktisch unmöglich machen. der gerichtshof hat zudem dargelegt, daß ein arbeitnehmer, der anspruch auf den rückwirkenden anschluß an ein betriebsrentensystem hat, sich der zahlung der beiträge für den betreffenden anschlußzeitraum nicht entziehen kann.
whereas, in its judgments of 28 september 1994 (6) (case c-57/93: vroege v. nciv instituut voor volkshuisvesting bv and case c-128/93: fisscher v. voorhuis hengelo bv), the court ruled that the abovementioned protocol did not affect the right to join an occupational pension scheme, which continues to be governed by the judgment of 13 may 1986 in case 170/84: bilka-kaufhaus gmbh v. hartz (7), and that the limitation of the effects in time of the judgment of 17 may 1990 in case c-262/88: barber v. guardian royal exchange assurance group does not apply to the right to join an occupational pension scheme; whereas the court also ruled that the national rules relating to time limits for bringing actions under national law may be relied on against workers who assert their right to join an occupational pension scheme, provided that they are not less favourable for that type of action than for similar actions of a domestic nature and that they do not render the exercise of rights conferred by community law impossible in practice; whereas the court has also pointed out that the fact that a worker can claim retroactively to join an occupational pension scheme does not allow the worker to avoid paying the contributions relating to the period of membership concerned;
