بائن بينونة صغرى: وهو الذي يجوز فيه للزوج أن يتزوج بمن طلقها بموجب عقد جديد وذلك لانتهاء مدة عدتها؛

والطلاق البائن على نوعين: الطلاق البائن بينونة صغرى ويقع لأقل من ثلاث مرات، ويمكن للزوج أن يستعيد زوجته بعقد ومهر جديدين، والطلاق البائن بينونة كبرى، بحيث لا يجوز للرجل أن يستعيد زوجته إلاّ إذا تزوجت المطلَّقة من غير مطلِّقها .
lesser irrevocable divorce is where the husband pronounces divorce less than three times; the husband may take back his wife on the basis of a new marriage contract and dowry. greater irrevocable divorce is where the husband may take back his wife only after she has remarried and divorced.
