1 puntland petroleum and minerals agency (ppma) on behalf of the state of puntland seeks the immediate withdrawal by the federal government and the mogadishu ministry of petroleum and minerals of the petroleum law it has put before the cabinet on august 2, 2015. this act is unconstitutional and ppma will not accept or tolerate this continuous and flagrant constitutional violation. furthermore, ppma will never recognize any petroleum law drafted by an illegal ministry, that is passed by a somali executive branch which does not have the constitutional power to pass it in a parliament that is missing it’s constitutionally required upper house, and does not have under the current constitution powers to legislate for this sector. 2 somalia’s federal provisional constitution 2012 clearly stipulates that the somali federal government and the federal parliament does not have the power to legislate on natural resources, let alone the oil, gas and minerals sector. articles 45, 55 (somali language version signed in nairobi, june 12, 2012; english version; articles 44 and 54) forbid the somali federal government to legislate on this sector until all federal member states are established, and the federal government and all the federal member states agree how best to govern this sector. 3 ppma is fully aware that there are foreign companies, like soma oil and gas behind the drafting and intended passing of this illegal law and that their involvement surrounding this legislation is to achieve their objectives of obtaining blocks before all the remaining somali federal member states are finally established. ppma also understand that this petroleum law is currently before the executive in an attempt to legitimize the illegal soma oil and gas deal that is now under corruption investigation in the united kingdom. 4 ppma welcomes the united kingdom’s serious fraud office criminal investigation into soma oil and gas allegedly. in this regard, ppma seeks the immediate cancellation of existing agreements and the open and public acknowledgement by the federal government and the somali executive branch that it has no authority whatsoever to enter into or continue with any agreement relating to natural resources with soma oil and gas or any other resource company.
