31- أما بالنسبة للمطالبة بنفقات العقود التي لم تصدر بها فواتير من جانب شركة صناعات التبريد فإنها قدمت ما يثبت بأنها أبرمت اتفاقين مع وزارة الكهرباء والمياه لتوفير وحدات تكييف الهواء لمشروع المدارس ذاته الذي جاء ذكره أعلاه فيما يتعلق بشركة الخليج للهندسة.

in relation to the claim for unbilled costs incurred pursuant to the contracts with the various ministries of the government of kuwait, the panel finds that the valuation approach taken by the claimant presents a substantial risk of overstatement of the claim, especially in the light of the fact that the claimant renegotiated two of the contracts following the liberation of kuwait and therefore might have been able to recover some of the unbilled costs in relation to those contracts.
33- وفيما يتصل بمطالبة التعويض عن التكاليف غير المدرجة في فواتير التي جرى تكبدها بموجب العقود المبرمة مع مختلف وزارات الحكومة الكويتية، يرى الفريق أن النهج الذي اتبعه صاحب المطالبة في تحديد القيمة ينطوي على احتمال كبير بالمبالغة في قيمة المطالبة، خاصة وأن صاحب المطالبة تفاوض من جديد على عقدين من هذه العقود بعد تحرير الكويت، وأنه ربما استرد بعض التكاليف غير المدرجة في فواتير فيما يخص هذين العقدين.
