the concept of civil and commercial matters must therefore be regarded as an independent concept to be interpreted by reference, first, to the objectives and scheme of the convention on jurisdiction and the enforcement of judgments and, secondly, to the general principles which stem from the national legal systems as a whole (case c-271/00 gemeente steenbergen [2002] ecr i-1489, paragraph 28), which means that the law of one of the member states is irrelevant to its interpretation.
