in case c-182/91 forafrique burkinabé ν commissionxit was claimed by the applicant that the commission had not only failed to comply with a garnishee order served against burkina faso but had also continued to make payments from the edf to that state without regard to the wrongful use made of the sums in question and after being informed that the applicant had not been paid for work carried out on a project because burkina faso had embezzled the funds. on 29 april the court held that no misconduct could be attributed to the commission.
