kadangi minėtame sprendime, kuris buvo išaiškintas 1993 m. gruodžio 14 d. sprendimu (moroni prieš collo gmbh byla c-110/91), teismas sutarties 119 straipsnį aiškina nurodydamas, kad apskritai draudžiama diskriminuoti dėl lyties profesinėse socialinės apsaugos sistemose, o ne tik nustatant pensinį amžių ar siūlant profesinę pensiją kaip kompensaciją už priverstinį išėjimą į pensiją dėl ekonominių priežasčių;
