142. con respecto a la disposición especial de la ley de seguridad nacional que estipula la prolongación del período de detención por inculpación, el tribunal constitucional reafirmó la constitucionalidad de la disposición, por fallo del 26 de junio de 1977, dictaminando que "con respecto a la investigación de delitos sometidos a los artículos 3, 5, 8, y 9 de la ley de seguridad nacional en el momento de su revisión el 31 de mayo de 1991, hubo motivos substanciales para prolongar el período de detención de los sospechosos en la menor medida de lo posible, y como la prolongación ha de ser aprobada por un juez, garantizándose así un mecanismo jurídico para prevenir detenciones prolongadas injustamente, el artículo 19 de la ley de seguridad interna que estipula una prolongación del período de detención por los delitos identificados en los artículos precedentes no es anticonstitucional con respecto al principio de igualdad, al derecho a la libertad personal, al principio de presunción de la inocencia, y al derecho a un juicio rápido estipulados en la constitución " (decisiones 1996 heon-ga 8, 9, y 10).
142. with respect to the special provision of the national security act stipulating an extended detention period for charges, the constitutional court assented to the constitutionality of the provision, by ruling on 26 june 1997 that, "with respect to the investigation of crimes subject to articles 3, 5, 8, and 9 of the national security act at the time of its revision on 31 may 1991, there was substantial reason to extend the period of detention of the suspects to the minimum possible extent, and as the extension is to be approved by a judge, thereby securing a legal mechanism for preventing unjustly prolonged detentions, article 19 of the national security act stipulating extension of a detention period for the crimes identified in the preceding articles is not unconstitutional with regard to the principle of equality, the right to personal liberty, the principle of presumption of innocence, and the right to speedy trial provided in the constitution " (decisions 1996 heon-ga 8, 9, and 10).
