oggetto:si commenta una sentenza del tribunale costituzionale tedesco del marzo 2010 secondo la quale la legge sulle telecomunicazioni (telekommunikationsgesetz tkg) e il §100g del codice di procedura penale (strafprozessordnung - stpo) che implementavano nell'ordinamento tedesco la direttiva 2006/24/ce, riguardante la conservazione di dati generati o trattati nell'ambito della fornitura di servizi di comunicazione elettronica, sono nulli poiché incostituzionali per violazione dell'art. 10.1 grundgesetz che protegge la segretezza delle comunicazioni
