według ogłoszenia komisji w sprawie zastosowania zasad pomocy państwa do środków odnoszących się do bezpośredniego opodatkowania przedsiębiorstw (dz.u. c 384 z 10.12.1998, str. 3-9), korzyści podatkowe ograniczone do pewnych typów przedsiębiorstw lub produkcji określonych towarów, mogą stanowić pomoc państwa. redukcja podstawy opodatkowania, a w konsekwencji poziomu opodatkowania, obowiązującego dla bt i kingston, pociąga za soba selektywne korzyści dla tych przedsiębiorstw, redukując koszty, które normalnie podczas działalności handlowej musiałyby one ponosić. rynek telekomunikacyjny zjednoczonego królestwa został otwarty dla konkurencji, dlatego też korzyści przyznane bt i kingston communications mogłyby zakłócić konkurencję i wywrzeć wpływ na handel. wydaje się, że spełnione są warunki zakwalifikowania powyższego środka jako pomocy państwa w świetle art. 87 ust. 1.
Σύμφωνα με την ανακοίνωση της Επιτροπής σχετικά με την εφαρμογή των κανόνων για τις κρατικές ενισχύσεις στα μέτρα που σχετίζονται με την άμεση φορολογία των επιχειρήσεων (ΕΕ c 384/3-9 της 10.12.1998), τα φορολογικά πλεονεκτήματα που χορηγούνται αποκλειστικά υπέρ ορισμένων μορφών επιχειρήσεων, στο βαθμό που ευνοούν ορισμένες επιχειρήσεις ή την παραγωγή ορισμένων αγαθών, μπορούν να συστήσουν κρατική ενίσχυση. Η μείωση της φορολογητέας βάσης και, κατά συνέπεια, της φορολογικής επιβάρυνσης της "bt" και της kingston, παρέχει στις επιχειρήσεις αυτές ένα επιλεκτικό πλεονέκτημα στο βαθμό που μειώνει τις συνήθεις επιβαρύνσεις του προϋπολογισμού τους. Η βρετανική αγορά τηλεπικοινωνιών έχει ανοίξει στον ανταγωνισμό και έτσι τα πλεονεκτήματα που χορηγήθηκαν στη "bt" και την kingston communications μπορούν να στρεβλώσουν τον ανταγωνισμό και να επηρεάσουν τις εμπορικές συναλλαγές. Φαίνεται ότι πληρούνται οι προϋποθέσεις που προβλέπει το άρθρο 87 παρ. 1 της συνθήκης ΕΚ για τον χαρακτηρισμό ενός μέτρου ως κρατική ενίσχυση.Κατά συνέπεια, στο παρόν στάδιο της διαδικασίας, η Επιτροπή κατέληξε στο συμπέρασμα ότι οι αρχές του Η.Β. χορήγησαν ενδεχομένως κρατική ενίσχυση στη "bt" και στην kingston communications κατά την έννοια του άρθρου 87 παρ. 1 της συνθήκης ΕΚ. Μολονότι η παρουσία στοιχείου ενίσχυσης μπορεί να αποκλειστεί όταν η προτιμησιακή μεταχείριση δικαιολογείται από τη φύση και τη γενική οικονομία του συστήματος, στην προκειμένη περίπτωση, η Επιτροπή αμφιβάλλει ότι αυτό μπορεί να δικαιολογηθεί με βάση τα χαρακτηριστικά και τη λογική του φορολογικού συστήματος.
