notwithstanding the provisions of article 7 and this article the contracting parties agree that pending the determination of a transitional period in accordance with article 9 and subsequently during the transitional period, the name 'hermitage` may be used for wines originating in australia as a synonym for the vine variety 'shiraz` for sale in countries outside the territory of the community in so far as the laws and regulations in australia and other countries permit provided that this name is not used in such a manner as to mislead consumers.
