fabio ghiselli, fabio marcus ghiselli, gary richardson, kenneth richard stevens, stuart allan mactaggart, mark anthony bennett och peter alan lissenburgh har medverkat i eller anstiftat till brott mot artiklarna 1.1,12, 349 och 350 i den spanska brottsbalken - d.v.s i strid med spansk lagstiftning importerat tullpliktigt gods (1188 limpor tullfria cigaretter till ett värde av mer än 1 000 000 pesetas) till spanien utan att betala skatt och avyttrat detta utan att betala skatt - i det att de mellan den 26 september 1993 och den 10 mars 1994 a. ordnat med tullnederlag i bristol, b. ordnat med leverans av 1180 limpor tullfria cigaretter till nämnda tullnederlag, c. ordnat så att samtliga 1180 limpor i tullnederlaget skickades från bristol med destination marocko, d. ordnat och stått för transporten av cigaretterna i tullnederlaget från bristol till dover, där de lastades på en färja till frankrike, e. erhållit och utfärdat färdhandlingar, d.v.s faktura nr 94010/093, carnet nr 10084583, c88 02/080 och cmr sf851169 för cigaretterna, f. införskaffat en falsk stämpel och stämplat talong nr 1 på carnet nr 10084583 som anger att lastbilen och cigaretterna anlänt till algeciras den 5.2.1994.
fabio ghiselli, fabio marcus ghiselli, gary richardson, kenneth richard stevens, stuart allan mactaggart, mark anthony bennett and peter alan lissenburgh between the 26th day of september 1993 and the 10th day of march 1994, by: a) arranging for use of bonded warehouse facilities in bristol. b) arranging for delivery of 1180 cartons of duty-free cigarettes to that bond, c) arranging for the sending of those 1180 cartons of cigarettes, in bond, from bristol, bound for morocco, d) arranging and providing transport for those cigarettes, in bond, from bristol to dover and onto a ferry for france, e) obtaining and providing travel documents, namely an invoice 94010/093, carnet 10084583, c88 02/080 and cmr sf851169 for those cigarettes, f) obtaining a false stamp and stamping volet no 1 camel 10084583 showing arrival of the lorry and cigarettes at algeciras on 5/2/94, assisted in or induced conduct, namely the importation of dutiable goods (1188 cartons of duty-free cigarettes, valued in excess of 1,000,000 pesetas) into spain without paying tax and their disposal without paying tax, contrary to the provisions of spanish law, namely articles 1.1, 12, 349 & 350 of the spanish penal code. 304
