tvrdit, že písemné prohlášení kapitána lodi ze dne 16. října 1997 týkající se provedených prací pochází od osoby patřící do okruhu osob ovlivněných žalobkyní v původním řízení, neplatilo to o spolupodpisu připojeném k tomuto prohlášení vedoucím pohraniční kontrolní veterinární stanice koper a posudku havarijních komisařů kähler & prinz ze dne 22. září 1998. a je nutno mít za to, že tak učinil, pokud si uvědomíme, že podle vyváženého posouzení rozdělení důkazního břemene měl německý správní orgán pouze povinnost prokázat „skutečnosti, které, souhrnně posouzeny, tvoří souhrn indicií svědčících se značnou pravděpodobností o tom, že […] směrnice o ochraně zvířat během přepravy nebyla dodržena“. je totiž třeba se domnívat, že přiznat význam kontrole ze dne 18. a 19. února 1997, ale nikoli jiným výše uvedeným skutečnostem, neodpovídá přiměřenému a vyčerpávajícímu posouzení skutkových okolností. 35.
