(12) podle § 4 burgenlandského zákona o zemských hypotečních bankách, lgbl. č. 58/1991, ve znění zákona lgbl. č. 63/1998, ručí země burgenland jako náhradní ručitel podle § 1356 všeobecného občanského zákoníku v případě platební neschopnosti bb za veškeré závazky společnosti. náhradní ručení země burgenland za bb a její právní předchůdce existuje v prakticky nezměněné formě již od roku 1928. zákonná úprava v současnosti platné záruky ručení vstoupila v platnost dne 29. června 1991 a země burgenland získala touto novelou zákona provizi na ručení za to, že je připravena k tomuto zákonnému náhradnímu ručení.
