na základe vyššie uvedeného navrhujem, aby súdny dvor odpovedal na otázky bundesverwaltungsgericht takto:
in the light of the foregoing, it is suggested that the court answer the questions asked by the bundesverwaltungsgericht as follows:

za týchto okolností bundesverwaltungsgericht rozhodol prerušiť konanie a položiť súdnemu dvoru túto prejudiciálnu otázku:
in those circumstances the verwaltungsgericht schwerin decided to stay proceedings and to refer the following question to the court of justice for a preliminary ruling:

súdny dvor svojím rozsudkom odpovedal na otázku bundesverwaltungsgericht (nemecký spolkový správny súd).
by this judgment the court has answered a question referred by the bundesverwaltungsgericht (german federal administrative court).

vzhľadom na vyššie uvedené úvahy navrhujem súdnemu dvoru, aby na prejudiciálne otázky predložené bundesverwaltungsgericht odpovedal takto:
in the light of the foregoing considerations, i propose that the court should reply to the questions referred for a preliminary ruling by the bundesverwaltungsgericht, declaring that:

za týchto okolností bundesverwaltungsgericht rozhodol prerušiť všetky tri konania vo veci samej a súdnemu dvoru položil nasledujúce prejudiciálne otázky:
in those circumstances, the bundesverwaltungsgericht, in the three cases in the main proceedings, decided to stay proceedings and to refer to the court the following questions for a preliminary ruling:

germany and deutsche telekom brought an appeal before the bundesverwaltungsgericht, which took the view that paragraph 43(6) of the tkg may be incompatible with community law.

the complainant and the zt then appealed to the bundesverwaltungsgericht (‘the bverwg’ — federal administrative court) against the ruling given by the oberverwaltungsgericht koblenz.

svojou prvou otázkou sa bundesverwaltungsgericht pýta, či jednotlivec môže požadovať od príslušných vnútroštátnych orgánov vypracovanie akčného plánu v prípade rizika prekročenia limitných hodnôt alebo výstražných prahov uvedeného v článku 7 ods. 3 smernice 96/62.
by its first question, the bundesverwaltungsgericht is asking whether an individual can require the competent national authorities to draw up an action plan in the case — referred to in article 7(3) of directive 96/62 — where there is a risk that the limit values or alert thresholds may be exceeded.
