Šiomis aplinkybėmis bundesverwaltungsgericht nusprendė sustabdyti bylos nagrinėjimą ir pateikti teisingumo teismui tokius prejudicinius klausimus:
in those circumstances, the bundesverwaltungsgericht, in the three cases in the main proceedings, decided to stay proceedings and to refer to the court the following questions for a preliminary ruling:

34 — Šiuo atžvilgiu bundesverwaltungsgericht nurodė, kad kasaciniai skundai negalėjo būti tenkinami taikant vien nacionalinę teisę.
34 — in this connection the bundesverwaltungsgericht observed that the appeals on a point of law could not succeed on the basis of national law alone.

atsižvelgdamas į tai, kas išdėstyta, siūlau teisingumo teismui į klausimus, dėl kurių bundesverwaltungsgericht pateikė prašymą priimti prejudicinį sprendimą, atsakyti paskelbiant, kad:
in the light of the foregoing considerations, i propose that the court should reply to the questions referred for a preliminary ruling by the bundesverwaltungsgericht, declaring that:

savo pirmuoju klausimu bundesverwaltungsgericht klausia, ar asmuo gali reikalauti, kad kompetentingos nacionalinės valdžios institucijos sudarytų veiksmų planą direktyvos 96/62 7 straipsnio 3 dalyje numatytu atveju, kai kyla pavojus viršyti ribines vertes ar pavojaus slenksčius.
by its first question, the bundesverwaltungsgericht is asking whether an individual can require the competent national authorities to draw up an action plan in the case — referred to in article 7(3) of directive 96/62 — where there is a risk that the limit values or alert thresholds may be exceeded.
