256- وإلى حين أن يُعهد بالأطفال المحرومين من الرعاية الأبوية إلى أسرة أو مؤسسة من المؤسسات المذكورة في الفقرة 1 من المادة 150 من مدونة الأسرة، تتحمل وكالة وصاية أو كفالة، بصفة مؤقتة، التزامات الكفيل.
256. until children deprived of parental care are placed in a family or in the institutions indicated in article 150, paragraph 1, of the family code, a tutorship or guardianship agency temporarily assumes the obligations of tutor.
)٢( التعهد الذي ينص على أن التزام الكفيل أو المصدر تجاه المستفيد مرهون بفعل أو حدث غير أكيد في المستقبل خﻻف تقديم المستندات المنصوص عليها ﻻ يكون مستقﻻ إﻻ إذا:
(2) an undertaking which provides that the guarantor's or issuer's obligation to the beneficiary is subject to a future, uncertain act or event other than presentation of stipulated documents is independent only if:
)١( ﻷغراض هذه اﻻتفاقية، يكون التعهد مستقﻻ حينما ﻻ يكون التزام الكفيل أو المصدر تجاه المستفيد مرهونا بوجود أو صﻻحية معاملة أصلية أو بأي حكم أو شرط ﻻ يظهر في التعهد.
(1) for the purposes of this convention, an undertaking is independent where the guarantor's or issuer's obligation to the beneficiary is not subject to the existence or validity of an underlying transaction or to any term or condition not appearing in the undertaking.
