when a writ of summons or an equivalent document has had to be transmitted to another member state for the purpose of service, under the provisions of this regulation, and a judgment has been entered against a defendant who has not appeared, the judge shall have the power to relieve the defendant from the effects of the expiration of the time for appeal from the judgment if the following conditions are fulfilled:
meta ċitazzjoni jew dokument ekwivalenti kellu jkun trażmess lill-stat membru ieħor għall-iskop ta' notifika, permezz tad-dispożizzjonijiet ta' dan ir-regolament, u tkun ġiet reġistrata sentenza kontra l-konvenut li ma jkunx deher, l-imħallef għandu jkollu l-poter li jeħles lill-konvenut minn l-effetti ta' l-iskadenza tat-terminu ta' l-appell mis-sentenza jekk il-kondizzjonijiet li ġejjin ikunu mwettqa:

'decision': any decision given in a matter of a matrimonial property regime by a court of a member state, whatever the decision may be called, including the terms 'decree', 'judgment', 'order' or 'writ of execution', and the determination of costs or expenses by an officer of the court;
"deċiżjoni" : kwalunkwe deċiżjoni mogħtija fil-qasam tar-reġim matrimonjali minn qorti ta’ stat membru, independentament minn kif tista' tissejjaħ id-deċiżjoni, inklużi t-termini "sentenza", "ġudizzju", "digriet" jew "mandat ta’ eżekuzzjoni", kif ukoll id-determinazzjoni tal-ispejjeż tal-proċess minn uffiċjal tal-qorti;
